This idea has been broadly articulated as the 60-Year Curriculum (60YC), and executing on this vision demands a fundamental change in how higher education institutions must operate to serve students. The 60YC proposes that higher education providers, who happen to be best in the world at knowledge creation and dissemination through well-designed curriculum, expand that curricula concept from the current two-year AA, four-year BA, two-year master’s and seven-year PhD learning models into a 60-year model inclusive of 15- to 75-year-old learners and, most likely, beyond.

Calls for learning have long been common at corporate retreats, professional conferences, and similar gatherings. But with the furious pace of change that technology has brought to business and society, they have become more urgent. Leaders in every sector seem to agree: Learning is an imperative, not a cliché. Without it, careers derail and companies fail. Talented people flock to employers that promise to invest in their development whether they will stay at the company or not.

If we are after transformative learning, what we need is a familiar yet open frame — a playground of sorts that magnifies our habits and the culture that breeds them so that we can examine both, and imagine and try new ways of being.

A boot camp must replicate workplace constraints to help us master ways of navigating them more efficiently. Whether it’s a course on, say, reaping insights from data analytics or a training session on giving respectful feedback, the space supports practice and improvement. A playground must remove most constraints to promote experimentation. Providing some distance from day-to-day reality allows us to get real in a deeper sense. A boot camp amplifies and exploits the shame of learning, helping us learn how not to be found wanting. A playground exposes and challenges that shame, helping us realize that if we were less anxious, it might be easier to claim what we want and discover how to get it.

A heads up. The way they use the word bootcamp is different from the way I’ve heard that word used these last 5-7 years. I think of bootcamps as more along the lines of a 10-12 week, intensive course — often involving programming. I don’t see them as internal training courses. But this article uses the word bootcamp in that way.

At the same time, AI presents an original set of inherent risks and potential harms. From a Law and Computational Technologies perspective, these circumstances can be broadly separated into two categories. First, we can consider the ethics, regulations, and laws that apply to technology. Second, we can consider the use of technology to improve the delivery of legal services, justice systems, and the law itself. Each category presents an unprecedented opportunity to use significant technological advancements to preserve and expand the rule of law.

For basic legal needs, access to legal services might come in the form of smartphones or other devices that are capable of providing users with an inventory of their legal rights and obligations, as well as providing insights and solutions to common legal problems. Better yet, AI and pattern matching technologies can help catalyze the development of proactive approaches to identify potential legal problems and prevent them from arising, or at least mitigate their risk.

We risk squandering abundant opportunities to improve society with computational technologies if we fail to proactively create frameworks to embed ethics, regulation, and law into our processes by design and default.

To move forward, technologists and lawyers must radically expand current notions of interdisciplinary collaboration. Lawyers must learn about technology, and technologists must learn about the law.

The top law schools recognize the need to train not just excellent lawyers but tech-savvy ones too, who understand the application of technology and its impact on the legal market. They are creating specialist courses for those who want to be more involved with the technology used to deliver legal advice.

In case it’s helpful or interesting, a person interested in a legal career needs to first get a Juris Doctor (J.D.) Degree, then pass the Bar. At that point, if they want to expand their knowledge in a certain area or areas, they can move on to getting an LL.M. Degree if they choose to.

As in the world of higher ed and also in the corporate training area, I have it that the legal field will need to move more towards the use of teams of specialists. There will be several members of the team NOT having law degrees. For example, technologists, programmers, user experience designers, etc. should be teaming up with lawyers more and more these days.

In the US, however, we also have a tragic lack of foresight. Instead of creating a grand strategy for AI or for our long-term futures, the federal government has removed the financing of scientific and technical research. The money must therefore come from the private sector. But investors also expect a certain return. That is a problem. You cannot plan your R&D breakthroughs when working on fundamental technology and research. It would be great if the big tech companies had the luxury of working very hard without having to organize an annual conference to show off their newest and best whiz bang thing. Instead, we now have countless examples of bad decisions made by someone in the G-MAFIA, probably because they worked quickly. We begin to see the negative effects of the tension between doing research that is in the interest of humanity and making investors happy.

The problem is that our technology has become increasingly sophisticated, but our thinking about what free speech is and what a free market economy looks like has not become that advanced. We tend to resort to very basic interpretations: free speech means that all speech is free, unless it conflicts with defamation laws, and that’s the end of the story. That is not the end of the story. We need to start a more sophisticated and intelligent conversation about our current laws, our emerging technology, and how we can make the two meet halfway.

 

So I absolutely believe that there is a way forward. But we have to come together and bridge the gap between Silicon Valley and DC, so that we can all steer the boat in the same direction.

Over the next decade, U.S. banks, which are investing $150 billion in technology annually, will use automation to eliminate 200,000 jobs, thus facilitating “the greatest transfer from labor to capital” in the industry’s history. The call is coming from inside the house this time, too—both the projection and the quote come from a recent Wells Fargo report, whose lead author, Mike Mayo, told the Financial Times that he expects the industry to shed 10 percent of all of its jobs.

This, Mayo said, will lay the groundwork for, and I quote, “a golden age of banking efficiency.” The job cuts are slated to hit front offices, call centers, and branches the hardest, where 20-30 percent of those roles will be on the chopping block. They will be replaced by better ATMs, automated chatbots, and software instruments that take advantage of big data and cloud computing to make investment decisions.

“The next decade should be the biggest decade for banks in technology in history,” Mayo said.

Google has released a huge database of deepfake videos that it’s created using paid actors. It hopes the database will bolster systems designed to detect AI-generated fake videos.

With the 2020 US Presidential elections looming, the race is on to build better systems to detect deepfake videos that could be used to manipulate and divide public opinion.

A do-it-yourself mindset is changing the face of education worldwide, according to new survey results. Learners are “patching together” their education from a “menu of options,” including self-teaching, short courses and bootcamps, and they believe that self-service instruction will become even more prevalent for lifelong learning. In the United Sates specifically, 84 percent of people said learning would become even more self-service the older they get.

Among those who have needed to reskill in the last two years to continue doing their jobs, 42 percent found information online and taught themselves and 41 percent took a course or training offered by their employers, a professional association or bootcamp, compared to just 28 percent who pursued a professional certification program, 25 percent who enrolled in a university-level degree program or 12 percent who did nothing.

If people had to learn something new for their career quickly, they said they would be more likely turn to a short training program (47 percent), followed by access to a free resource such as YouTube, Lynda.com or Khan Academy (33 percent). A smaller share (20 percent) would head to an accredited university or college.

This is why the prediction from Thomas Frey carries weight and why I’ve been tracking a new learning platform for the 21st century. Given:

  • The exponential pace of technological change occurring in many societies throughout the globe

  • That emerging technologies are game-changers in many industries
  • That people will need to learn about those emerging technologies and how to leverage/use them <– if they want to remain marketable/employed
  • That people need to reinvent themselves quickly, efficiently, and cost-effectively
  • That many people can’t afford the time nor the funding necessary these days to acquire a four-year higher ed degree
  • That running new courses, programs, etc. through committees, faculty senates, etc. takes a great deal of time…and time is something we no longer have (given this new pace of change)

…there needs to be a new, up-to-date, highly responsive, inexpensive learning-related platform for the 21st century. I call this learning platform of the future, “Learning from the Living [Class] Room.” And while it requires subject matter experts / humans in significant ways, AI and other technologies will be embedded throughout such a platform.

Mary Grush: Why should new technologies be part of a legal education?

Daniel Christian: I think it’s a critical point because our society, at least in the United States — and many other countries as well — is being faced with a dramatic influx of emerging technologies. Whether we are talking about artificial intelligence, blockchain, Bitcoin, chatbots, facial recognition, natural language processing, big data, the Internet of Things, advanced robotics — any of dozens of new technologies — this is the environment that we are increasingly living in, and being impacted by, day to day.

It is so important for our nation that legal professionals — lawyers, judges, attorney generals, state representatives, and legislators among them — be up to speed as much as possible on the technologies that surround us: What are the issues their clients and constituents face? It’s important that legal professionals regularly pulse check the relevant landscapes to be sure that they are aware of the technologies that are coming down the pike. To help facilitate this habit, technology should be part of the culture for those who choose a career in law. (And what better time to help people start to build that habit than within the law schools of our nation?)

 

There is a real need for the legal realm to catch up with some of these emerging technologies, because right now, there aren’t many options for people to pursue. If the lawyers, and the legislators, and the judges don’t get up to speed, the “wild wests” out there will continue until they do.
