What does this all mean for the first day of class? Approach that first day with “learning-centered” in your mind. Focus on learning. Learning is all about curiosity and desire. Desire to know, to figure things out, to be surprised, all getting that dopamine flowing throughout the brain: That is what learning-centered is all about. An exam is best thought of as feedback, showing whether students are learning, not a date to cover on the first day and dread every class period in the meantime. An exam should never be the reason to learn, it should always be an indication of learning. Don’t spend your first 45 or 85 minutes focused solely on exams, term paper deadlines, and attendance policies. That moves teaching toward an artificial transactional arrangement where students learn in exchange for points and grades.

I would highly recommend starting out with a major HOOK. Some question, some video, some recording/piece of audio, etc. that would provoke interest, curiosity, or even some emotion. On that first day, the following item MUST be addressed if you expect to engage your students:

Can new AI help to level up the scales of justice?

As you can see from the above items, Mr. David Goodrich, a great human being and a fellow Instructional Designer, had a great comment and question regarding the source of my hope that AI — and other forms of legaltech — could significantly provide more access to justice here in America. Our civil justice system has some serious problems — involving such areas as housing, employment, healthcare, education, families, and more.

I’d like to respond to that question here.

First of all, I completely get what David is saying. I, too, have serious doubts that our horrible access to justice (#A2J) situation will get better. Why? Because:

  • Many people working within the legal field like it this way, as they are all but assured victory in most of the civil lawsuits out there.
  • The Bar Associations of most of the states do not support changes that would threaten their incomes/livelihoods. This is especially true in California and Florida.
  • The legal field in general is not composed, for the most part, of highly innovative people who make things happen for the benefit of others. For example, the American Bar Association is 20+ years behind in terms of providing the level of online-based learning opportunities that they should be offering. They very tightly control how legal education is delivered in the U.S.

Here are several areas that provide me with hope for our future

  • Artificial Intelligence (AI) and Machine Learning (ML) 
    • AI and machine learning remain pivotal in legaltech, especially for in-house lawyers who deal with vast quantities of contracts and complex legal matters. In 2024, these technologies will be integral for legal research, contract review, and the drafting of legal documents. Statistics from the Tech & the Law 2023 Report state more than three in five corporate legal departments (61%) have adopted generative AI in some capacity, with 7% actively using generative AI in their day-to-day work. With constant improvements to LLM (Large Language Models) by the big players, i.e. OpenAI, Google, and Microsoft (via OpenAI), 2024 will see more opportunities open and efficiencies gained for legal teams.     • From drafting contracts to answering legal questions and summarising legal issues, AI is revolutionising the legal profession and although viewed with a sceptical eye by some law firms, is generally perceived to be capable of bringing huge benefits. (Source)

  • Technology-assisted review (TAR) in e-discovery
  • Due to COVID 19, there were virtual courtrooms set up and just like with virtual/online-based learning within higher education, many judges, litigants, lawyers, and staff appreciated the time savings and productivity gains. Along these lines, see Richard Susskind’s work. [Richard] predicts a world of online courts, AI-based global legal businesses, disruptive legal technologies, liberalized markets, commoditization, alternative sourcing, simulated practice on the metaverse, and many new legal jobs. There are innovative states out there fighting for change. For examples:

  • Utah in 2020 launched a pilot program that suspended ethics rules to allow for non-lawyer ownership of legal services providers and let non-lawyers apply for a waiver to offer certain legal services. (Source)
  • Arizona in 2021 changed its regulatory rules to allow for non-lawyer ownership. (Source)
  • Alaska with their Alaska Legal Services Corporation
  • …and others

And the last one — but certainly not the least one — is where my faith comes into play. I believe that the Triune God exists — The Father, The Son, and The Holy Spirit — and that the LORD is very active in our lives and throughout the globe. And one of the things the LORD values highly is JUSTICE. For examples:

  • Many seek an audience with a ruler, but it is from the Lord that one gets justice. Proverbs 29:26 NIV
  • These are the things you are to do: Speak the truth to each other, and render true and sound judgment in your courts; Zechariah 8:16 NIV

The LORD values JUSTICE greatly!


So I believe that the LORD will actively help us provide greater access to justice in America.

With identity fraud on the increase there is a growing demand from the Government for people to be identified with accuracy and they are proposing to pass legislation in February 2024 that will tighten the requirements for the professional organisations involved.  They will promote the use of technology to reduce the risk of fraudulent transactions including mortgage fraud where according to Experian’s Report “the greatest jump in fraud cases has been seen …. with fraud increasing from around 41 cases to around 52 cases per 10,000 applications.”

But is this a real opportunity, and will AI be key to its realisation?

However, while AI may reduce the justice gap between the “haves” and “have-nots” of litigation, it could also exacerbate existing inequalities.

While this article approaches things from the lawyer’s viewpoint, I’d like to see this question and the use of AI from the common man’s/woman’s viewpoint. Why? In order to provide FAR GREATER access to justice (#A2J) for those who can’t afford a lawyer as they head into the civil law courtrooms.

  • Should I take my case to court? Do I have a chance to win this case? If so, how?
  • What forms do I need to complete if I’m going to go to court?
  • When and how do I address the judge?
  • What does my landlord have to do?
  • How do I prevent myself from falling into a debt-collection mess and/or what options do I have to get out of this mess?
  • Are there any lawyers in my area who would take my case on a pro bono basis?
  • …and judges and lawyers — as well as former litigants — could add many more questions (and answers) to this list

Bottom line:

I am not sure who said it first, but there are only two ways to react to exponential change: too early or too late. Today’s AIs are flawed and limited in many ways. While that restricts what AI can do, the capabilities of AI are increasing exponentially, both in terms of the models themselves and the tools these models can use. It might seem too early to consider changing an organization to accommodate AI, but I think that there is a strong possibility that it will quickly become too late.

Instructure seeks a leadership role in working with other organizations to establish common standards for credentials and learner records, to help create consistency. The future we get is the future that you and I start making in the present, meaning today, right now.

Two initial high-level takeaways from the convening include:

  • Every state effort is different for a reason. There are many factors that leaders must consider when determining which model(s) of regulatory reform to pursue and how. Some examples of factors to consider include whether the state is a mandatory or voluntary bar state, whether the supreme court justices in the state are appointed or elected, and whether the model(s) to be pursued is market-based or free to consumers. The answers to these questions will likely dictate which stakeholders will likely be allies, which stakeholders will likely be opposed, and which strategy and approach to pursue.

  • We need to better engage the public in regulatory reform efforts. While some organizations and efforts have included public engagement from the outset, (shout-outs to Innovation for Justice and Arizona more generally, as well as Alaska Legal Services Corporation and Frontline Justice), most have not, and this has likely hindered efforts to some degree. The data we have thus far indicates the public is interested in obtaining legal services from alternative service providers such as allied legal professionals and community justice workers, as well as through alternative business models. The more we can engage the public in this conversation, the better chance we have of creating regulatory reform that is aligned with their needs and the better chance leaders have of getting their respective efforts over the finish line.
    • Because this is an area within the regulatory reform space that is ripe for further development and impact, IAALS will soon be launching a project on consumer engagement. Stay tuned for more updates!

IAALS will share a more comprehensive list of lessons learned and recommendations for building and sustaining regulatory reform in its post-convening report, currently set to be released in early 2024.

AI Tutor as a way to provide students with 24/7 assistance as well as help level the playing field for those families who cannot afford a private tutor. If everything goes according to plan, every student in the United Arab Emirates’ school system will have a personal AI tutor – that fits in their pockets.

It’s a story that involves an element of coincidence, a forward-looking education minister and a tech team led by a chief executive officer who still lives at home with his parents.

In February 2023, the U.A.E.’s education minister, His Excellency Dr. Ahmad Belhoul Al Falasi, announced that the ministry was embracing AI technology and pursuing the idea of an AI tutor to help Emirati students succeed. Instead of fully embracing pedagogical methods that place primary emphasis on promoting collaboration, critical thinking, communication, creativity, and self-learning through experiential, interdisciplinary approaches grounded in human deep learning and combined with current technologies, a substantial portion of the educational system continues to heavily rely on traditional instructional methods and goals. These methods and goals prioritize knowledge acquisition and organization, areas in which machines already perform substantially better than people.

Our education system has a uni-dimensional focus: learning things. Of course, we say we care about developing the whole learner, but the metrics that matter (grade, transcripts) that underpin the education system are largely focused on teaching students things that have long been Google-able but are now increasingly doable by AI. Developments in AI matters in ways that calls into question large parts of what happens in our universities. This is not a statement that people don’t need to learn core concepts and skills. My point is that the fulcrum of learning has shifted. Knowing things will continue to matter less and less going forward as AI improves its capabilities. We’ll need to start intentionally developing broader and broader attributes of learners: metacognition, wellness, affect, social engagement, etc. Education will continue to shift toward human skills and away from primary assessment of knowledge gains disconnected from skills and practice and ways of being.

Librarians have lived through the disruptions of fax machines, websites and Wikipedia, and now they are bracing to do it again as artificial intelligence tools go mainstream: “Maybe it’s our time to shine.”

A few months after ChatGPT launched last fall, faculty and students at Northwestern University had many questions about the building wave of new artificial intelligence tools. So they turned to a familiar source of help: the library.

“At the time it was seen as a research and citation problem, so that led them to us,” said Michelle Guittar, head of instruction and curriculum support at Northwestern University Libraries.

In response, Guittar, along with librarian Jeanette Moss, created a landing page in April, “Using AI Tools in Your Research.” At the time, the university itself had yet to put together a comprehensive resource page.

As an educator, I have a duty to remain informed about the latest developments in generative AI, not only to ensure learning is happening, but to stay on top of what tools exist, what benefits and limitations they have, and most importantly, how students might be using them.

However, it’s also important to acknowledge that the quality of work produced by students now requires higher expectations and potential adjustments to grading practices. The baseline is no longer zero, it is AI. And the upper limit of what humans can achieve with these new capabilities remains an unknown frontier.

It’s an era many instructors would like to put behind them: black boxes on Zoom screens, muffled discussions behind masks, students struggling to stay engaged. But how much more challenging would teaching during the pandemic have been if colleges did not have experts on staff to help with the transition? On many campuses, teaching-center directors, instructional designers, educational technologists, and others worked alongside professors to explore learning-management systems, master video technology, and rethink what and how they teach.

A new book out this month, Higher Education Beyond Covid: New Teaching Paradigms and Promise, explores this period through the stories of campus teaching and learning centers. Their experiences reflect successes and failures, and what higher education could learn as it plans for the future.

As usual, our readers were full of suggestions. Kathryn Schild, the lead instructional designer in faculty development and instructional support at the University of Alaska at Anchorage, shared a guide she’s compiled on holding asynchronous discussions, which includes a section on difficult topics.

In an email, Schild also pulled out a few ideas she thought were particularly relevant to Le’s question, including:

  • Set the ground rules as a class. One way to do this is to share your draft rules in a collaborative document and ask students to annotate it and add suggestions.
  • Plan to hold fewer difficult discussions than in a face-to-face class, and work on quality over quantity. This could include multiweek discussions, where you spiral through the same issue with fresh perspectives as the class learns new approaches.
  • Start with relationship-building interactions in the first few weeks, such as introductions, low-stakes group assignments, or peer feedback, etc.
