Higher education alone cannot keep up with the rate of technological change. Industry-led skills-based training programs will emerge that more closely resemble the journeys of skilled tradespeople. This shift to continuous learning will benefit individuals and businesses alike.

Similar to the software development processes of decades past, we have reached a pivotal point with tech education, and we will see what was once bespoke on-the-job-training for a few evolve into industry-led skills-based education for many.

We have seen glimpses of this shift underway for years. Companies like Coursera, who originally focused on consumers, have partnered with enterprises to scale their upskilling and reskilling efforts. Degree apprenticeships have continued to grow in popularity because education can be specialized by the employer, and apprentices can earn as they learn. But now, companies themselves are starting to seriously invest in skills-based education at scale.

All of these programs enable learners at different points in their career journey to gain the exact skills they need to enter in-demand roles, without the commitment of a traditional multi-year program.

But there will be many industries where the impact of technology outpaces traditional educational systems. To meet the demands of business, we will see a new era of industry-led educational opportunities that can’t be ignored.

It seems to me that this is saying that higher education is not able to — nor will it be able to in the future — match the speed of innovation taking place today. Therefore, alternatives will continue to hit the learning landscapes/radar. For example, Amazon’s CTO, Dr. Werner Vogels, mentioned Amazon’s efforts here:

Amazon just announced that it has already trained 21 million tech learners across the world in tech skills. And it’s in part thanks to programs like the Mechatronics and Robotics Apprenticeship and AWS Cloud Institute.

What does this all mean for the first day of class? Approach that first day with “learning-centered” in your mind. Focus on learning. Learning is all about curiosity and desire. Desire to know, to figure things out, to be surprised, all getting that dopamine flowing throughout the brain: That is what learning-centered is all about. An exam is best thought of as feedback, showing whether students are learning, not a date to cover on the first day and dread every class period in the meantime. An exam should never be the reason to learn, it should always be an indication of learning. Don’t spend your first 45 or 85 minutes focused solely on exams, term paper deadlines, and attendance policies. That moves teaching toward an artificial transactional arrangement where students learn in exchange for points and grades.

I would highly recommend starting out with a major HOOK. Some question, some video, some recording/piece of audio, etc. that would provoke interest, curiosity, or even some emotion. On that first day, the following item MUST be addressed if you expect to engage your students:

Why is this class/topic relevant?

Start with that. Immediately. The other stuff can be introduced later on, as Todd mentions.

Narrowly Tailored, Purpose-Built AI
In 2024, I predict we’ll see narrower AI solutions. While ChatGPT may be a great general AI assistant, it’s unlikely to “win” for every task. I expect we’ll see an AI platform purpose-built for researchers, a writing generation tool targeted for journalists, and a rendering platform specifically for designers, to give just a few examples.

Over the longer term, I think the products people use on an everyday basis will be tailored to their use cases — whether this is a proprietary underlying model or a special workflow built around it. These companies will have the chance to “own” the data and workflow for a new era of technology; they’ll do this by nailing one category, then expanding. For the initial product, the narrower the better.

Can new AI help to level up the scales of justice?

As you can see from the above items, Mr. David Goodrich, a great human being and a fellow Instructional Designer, had a great comment and question regarding the source of my hope that AI — and other forms of legaltech — could significantly provide more access to justice here in America. Our civil justice system has some serious problems — involving such areas as housing, employment, healthcare, education, families, and more.

I’d like to respond to that question here.

First of all, I completely get what David is saying. I, too, have serious doubts that our horrible access to justice (#A2J) situation will get better. Why? Because:

  • Many people working within the legal field like it this way, as they are all but assured victory in most of the civil lawsuits out there.
  • The Bar Associations of most of the states do not support changes that would threaten their incomes/livelihoods. This is especially true in California and Florida.
  • The legal field in general is not composed, for the most part, of highly innovative people who make things happen for the benefit of others. For example, the American Bar Association is 20+ years behind in terms of providing the level of online-based learning opportunities that they should be offering. They very tightly control how legal education is delivered in the U.S.

Here are several areas that provide me with hope for our future

There are innovative new tools and technologies out there such as:

  • Artificial Intelligence (AI) and Machine Learning (ML) 
    • AI and machine learning remain pivotal in legaltech, especially for in-house lawyers who deal with vast quantities of contracts and complex legal matters. In 2024, these technologies will be integral for legal research, contract review, and the drafting of legal documents. Statistics from the Tech & the Law 2023 Report state more than three in five corporate legal departments (61%) have adopted generative AI in some capacity, with 7% actively using generative AI in their day-to-day work. With constant improvements to LLM (Large Language Models) by the big players, i.e. OpenAI, Google, and Microsoft (via OpenAI), 2024 will see more opportunities open and efficiencies gained for legal teams.     • From drafting contracts to answering legal questions and summarising legal issues, AI is revolutionising the legal profession and although viewed with a sceptical eye by some law firms, is generally perceived to be capable of bringing huge benefits. (Source)
    • Legal bots like Harvey will assist lawyers with discovery.
  • Technology-assisted review (TAR) in e-discovery
  • Due to COVID 19, there were virtual courtrooms set up and just like with virtual/online-based learning within higher education, many judges, litigants, lawyers, and staff appreciated the time savings and productivity gains. Along these lines, see Richard Susskind’s work. [Richard] predicts a world of online courts, AI-based global legal businesses, disruptive legal technologies, liberalized markets, commoditization, alternative sourcing, simulated practice on the metaverse, and many new legal jobs. There are innovative states out there fighting for change. For examples:

  • Utah in 2020 launched a pilot program that suspended ethics rules to allow for non-lawyer ownership of legal services providers and let non-lawyers apply for a waiver to offer certain legal services. (Source)
  • Arizona in 2021 changed its regulatory rules to allow for non-lawyer ownership. (Source)
  • Alaska with their Alaska Legal Services Corporation
  • …and others

And the last one — but certainly not the least one — is where my faith comes into play. I believe that the Triune God exists — The Father, The Son, and The Holy Spirit — and that the LORD is very active in our lives and throughout the globe. And one of the things the LORD values highly is JUSTICE. For examples:

  • Many seek an audience with a ruler, but it is from the Lord that one gets justice. Proverbs 29:26 NIV
  • These are the things you are to do: Speak the truth to each other, and render true and sound judgment in your courts; Zechariah 8:16 NIV

The LORD values JUSTICE greatly!


So I believe that the LORD will actively help us provide greater access to justice in America.

Not only is this a brilliant marketing move — as recipients can get an idea of the services/value offered — but it can provide concrete information to someone.

Perhaps colleges and universities should take this idea and run with it. They could gift courses and/or individual lectures! Doing so could open up some new revenue streams, aid adult learners in their lifelong learning pathways, and help people build new skills — all while helping market the colleges and universities. Involved faculty/staff members could get a percentage of the sales. Sounds like a WIN-WIN to me.

LERs Are Hot. What Are States Going To Do With Them?

Governors and state leaders are concerned about the current labor shortage, occurring during a time when many skilled workers are underemployed or even unemployed. Skills-based approaches to hiring and recruiting can shift that dynamic—making pathways to good careers accessible to a wider segment of the workforce and opening up new pools of talent for employers. They do so by focusing on what workers know and can do, not on the degrees or credentials they’ve earned.

That’s the theory. But a lot hinges on how things actually play out on the ground.

Technology will play a key role, and many states have zeroed in on learning and employment records—essentially digital resumes with verified records of people’s skills, educational experiences, and work histories—as an essential tool. A lot of important work is going into the technical design and specifications.

This project, on the other hand, aims to take a step back and look at the current state of play when it comes to the use cases for LERs. Just a few of the key questions:

  • How might employers, education providers, government agencies, and workers themselves actually use them? Will they?
  • In what areas do state policymakers have the most influence over key stakeholders and the most responsibility to invest?
  • What actions are needed now to ensure that LERs, and skills-based hiring more broadly, actually widen access to good jobs—rather than setting up a parallel system that perpetuates many of today’s inequities?

Last year, in “The Partnership Imperative,” we put forth a set of more than 40 best practices that employers and educators can use to develop a close collaboration. As part of that effort, we identified three main goals and laid out strategies for achieving each.

  1. Partner with each other to offer training and education that is aligned with industry needs. (DSC: Similar to how Instructional Designers want alignment with learning objectives, learning activities, and assessments of learning.)
  2. Establish relationships with each other that result in the recruitment and hiring of students and graduates.
  3. Make supply-and-demand decisions that are informed by the latest data and trends.

Under #1, their strategies include:

Cocreate and regularly update college curriculums so that they reflect relevant technical and foundational skills based on industry needs. Codesign programs that fit with students’ lives and industry hiring cycles. Incorporate classroom experiences that simulate real-world settings and scenarios.

I see AI being able to identify what those changing, currently sought-after, and foundational skills are based on industry needs (which shouldn’t be hard, and vendors like Microsoft are already doing this by combing through the posted job descriptions on their platforms). These findings/results will help build regularly updated learning playlists and should provide guidance to learning-related organizations/groups/individuals/teams on what content to develop and offer  (i.e., courses/learning modules/micro-learning-based streams of content, other).

So asks a recent study by two academics from Stanford Law School, David Freeman Engstrom and Nora Freeman Engstrom, on the potential impact of AI on the civil litigation landscape in the US.

It is against this landscape, the study observes, that champions of legal tech have suggested that there is an opportunity for legal tech to “democratise” litigation and put litigation’s “haves” and “have nots” on a more equal footing, by arming smaller firms and sole practitioners with the tools necessary to do battle against their better resourced opponents, and cutting the cost of legal services, putting lawyers within reach of a wider swathe of people.

But is this a real opportunity, and will AI be key to its realisation?

However, while AI may reduce the justice gap between the “haves” and “have-nots” of litigation, it could also exacerbate existing inequalities.

While this article approaches things from the lawyer’s viewpoint, I’d like to see this question and the use of AI from the common man’s/woman’s viewpoint. Why? In order to provide FAR GREATER access to justice (#A2J) for those who can’t afford a lawyer as they head into the civil law courtrooms.

  • Should I take my case to court? Do I have a chance to win this case? If so, how?
  • What forms do I need to complete if I’m going to go to court?
  • When and how do I address the judge?
  • What does my landlord have to do?
  • How do I prevent myself from falling into a debt-collection mess and/or what options do I have to get out of this mess?
  • Are there any lawyers in my area who would take my case on a pro bono basis?
  • …and judges and lawyers — as well as former litigants — could add many more questions (and answers) to this list

Bottom line:
It is my hope that technology can help increase access to justice.

A Digital Canvas for Skills
Instructure was a player in the skills and credentials space before its recent acquisition of Parchment, a digital transcript company. But that $800M move made many observers wonder if Instructure can develop digital records of skills that learners, colleges, and employers might actually use broadly.

Ultimately, he says, the CLR approach will allow students to bring these various learning types into a coherent format for employers.

Instructure seeks a leadership role in working with other organizations to establish common standards for credentials and learner records, to help create consistency. The company collaborates closely with 1EdTech. And last month it helped launch the 1EdTech TrustEd Microcredential Coalition, which aims to increase quality and trust in digital credentials.

Several American states are rewriting the rules of lawyer licensure and bringing the US into line with a key element of lawyer formation worldwide: supervised practice.

Change comes so gradually and fitfully to the legal sector that when something truly revolutionary happens — an actual turning point with an identifiable real-world impact — we have to mark the occasion. One such revolution broke out in the United States last week, opening up fantastic new possibilities for Americans who want to become lawyers.

The Oregon Supreme Court approved a new licensure program that does not require passage of a traditional written bar exam. After graduating from law school, aspiring Oregon lawyers can complete 675 hours of paid legal work under the supervision of an experienced attorney, assembling a portfolio of legal work to be assessed by bar admission officials. Candidates must submit eight samples of legal writing, take the lead in at least two initial client interviews or client counseling sessions, and oversee two negotiations, among other requirements.

While federal law mandates public schools provide an appropriate education to students with disabilities, it’s often up to parents to enforce it.

Schwarten did what few people have the resources to do: she hired a lawyer and requested a due process hearing. It’s like a court case. And it’s intended to resolve disputes between families and schools over special education services.

It’s also a traumatic and adversarial process for families and schools that can rack up hundreds of thousands of dollars in legal fees and destroy relationships between parents and district employees. And even when families win, children don’t always get the public education they deserve.

But computer science lessons like the ones at Dzantik’i Heeni Middle School are relatively rare. Understanding the Disconnect
We often find ourselves in professional development sessions that starkly contrast with the interactive and student-centred learning environments we create. We sit as passive recipients rather than active participants, receiving generic content that seldom addresses our unique experiences or teaching challenges.

This common scenario highlights a significant gap in professional development: the failure to apply the principles of adult learning, or andragogy, which acknowledges that educators, like their students, benefit from a learning process that is personalised, engaging, and relevant.

The irony is palpable — while we foster environments of inquiry and engagement in our classrooms, our learning experiences often lack these elements.

The disconnect prompts a vital question: If we are to cultivate a culture of lifelong learning among our students, shouldn’t we also embody this within our professional growth? It’s time for the professional development of educators to reflect the principles we hold dear in our teaching practices.
