So asks a recent study by two academics from Stanford Law School, David Freeman Engstrom and Nora Freeman Engstrom, on the potential impact of AI on the civil litigation landscape in the US.

It is against this landscape, the study observes, that champions of legal tech have suggested that there is an opportunity for legal tech to “democratise” litigation and put litigation’s “haves” and “have nots” on a more equal footing, by arming smaller firms and sole practitioners with the tools necessary to do battle against their better resourced opponents, and cutting the cost of legal services, putting lawyers within reach of a wider swathe of people.

But is this a real opportunity, and will AI be key to its realisation?

However, while AI may reduce the justice gap between the “haves” and “have-nots” of litigation, it could also exacerbate existing inequalities.

While this article approaches things from the lawyer’s viewpoint, I’d like to see this question and the use of AI from the common man’s/woman’s viewpoint. Why? In order to provide FAR GREATER access to justice (#A2J) for those who can’t afford a lawyer as they head into the civil law courtrooms.

  • Should I take my case to court? Do I have a chance to win this case? If so, how?
  • What forms do I need to complete if I’m going to go to court?
  • When and how do I address the judge?
  • What does my landlord have to do?
  • How do I prevent myself from falling into a debt-collection mess and/or what options do I have to get out of this mess?
  • Are there any lawyers in my area who would take my case on a pro bono basis?
  • …and judges and lawyers — as well as former litigants — could add many more questions (and answers) to this list

Bottom line:
It is my hope that technology can help increase access to justice.

This tool is aimed at addressing the struggles that individuals often face in deciphering legal jargon and understanding the nature of their legal issue and the type of lawyer, or legal support, they need to resolve that problem.

The recent drama over at OpenAI reminds me of how important a few individuals are in influencing the lives of millions of people.

The C-Suites (i.e., the Chief Executive Officers, Chief Financial Officers, Chief Operating Officers, and the like) of companies like OpenAI, Alphabet (Google), Meta (Facebook), Microsoft, Netflix, NVIDIA, Amazon, Apple, and a handful of others have enormous power. Why? Because of the enormous power and reach of the technologies that they create, market, and provide.

We need to be praying for the hearts of those in the C-Suites of these powerful vendors — as well as for their Boards.

LORD, grant them wisdom and help mold their hearts and perspectives so that they truly care about others. May their decisions not be based on making money alone…or doing something just because they can.

What happens in their hearts and minds DOES and WILL continue to impact the rest of us. And we’re talking about real ramifications here. This isn’t pie-in-the-sky thinking or ideas. This is for real. With real consequences. If you doubt that, go ask the families of those whose sons and daughters took their own lives due to what happened out on social media platforms. Disclosure: I use LinkedIn and Twitter quite a bit. I’m not bashing these platforms per se. But my point is that there are real impacts due to a variety of technologies. What goes on in the hearts and minds of the leaders of these tech companies matters.

No doubt, technology influences us in many ways we don’t fully understand. But one area where valid concerns run rampant is the attention-seeking algorithms powering the news and media we consume on modern platforms that efficiently polarize people. Perhaps we’ll call it The Law of Anger Expansion: When people are angry in the age of algorithms, they become MORE angry and LESS discriminate about who and what they are angry at.

Algorithms that optimize for grabbing attention, thanks to AI, ultimately drive polarization.

The AI learns quickly that a rational or “both sides” view is less likely to sustain your attention (so you won’t get many of those, which drives the sensation that more of the world agrees with you). But the rage-inducing stuff keeps us swiping.

Our feeds are being sourced in ways that dramatically change the content we’re exposed to.

And then these algorithms expand on these ultimately destructive emotions – “If you’re afraid of this, maybe you should also be afraid of this” or “If you hate those people, maybe you should also hate these people.”

How do we know when we’ve been polarized? This is the most important question of the day.

Whatever is inflaming you is likely an algorithm-driven expansion of anger and an imbalance of context.

As I’ve long stated on the Learning from the Living [Class]Room vision, we are heading toward a new AI-empowered learning platform — where humans play a critically important role in making this new learning ecosystem work.

Along these lines, I ran into this site out on X/Twitter. We’ll see how this unfolds, but it will be an interesting space to watch.

A Digital Canvas for Skills
Instructure was a player in the skills and credentials space before its recent acquisition of Parchment, a digital transcript company. But that $800M move made many observers wonder if Instructure can develop digital records of skills that learners, colleges, and employers might actually use broadly.

Ultimately, he says, the CLR approach will allow students to bring these various learning types into a coherent format for employers.

Instructure seeks a leadership role in working with other organizations to establish common standards for credentials and learner records, to help create consistency. The company collaborates closely with 1EdTech. And last month it helped launch the 1EdTech TrustEd Microcredential Coalition, which aims to increase quality and trust in digital credentials.

Where should we even begin? So we asked dozens of people to identify what problem at the intersection of technology and society that they think we should focus more of our energy on. We queried scientists, journalists, politicians, entrepreneurs, activists, and CEOs.

Some broad themes emerged: the climate crisis, global health, creating a just and equitable society, and AI all came up frequently. There were plenty of outliers, too, ranging from regulating social media to fighting corruption.

MIT Technology Review interviews many people to weigh in on the underserved issues at the intersections of technology and society.

McKinsey research shows that a focus on aspiration, activation, and execution can help companies out-innovate and outgrow peers.

To find out, we identified and analyzed about 650 of the largest public companies that achieved profitable growth relative to their industry between 2016 and 2021 while also excelling in the essential capabilities associated with innovation.3 Some of these companies outgrew their peers, others were more innovative than competitors, but 53 companies managed to do both. The 50-plus “innovative growers,” as we call them, are a diverse group, spread across four continents and ten industries. They include renowned brands with a trillion-dollar market capitalization as well as smaller companies that are just starting to make a name for themselves, some as young as three years old (see sidebar, “Where do innovative growers come from?”).

For all their diversity, these companies consistently excel in both growth and innovation—and they share a number of best practices that other companies can learn from.

Do innovative growers perform better than others?

In a word, yes.

Chris Perkins, associate partner, McKinsey: Promoting diversity in tech is more nuanced than driving traditional diversity initiatives. This is primarily because of the specialized hard and soft skills required to enter tech-oriented professions and succeed throughout their careers. Our research shows us that various actors, such as nonprofits, for-profits, government agencies, and educational institutions are approaching the problem in small pockets. Could we help catalyze an ecosystem with wraparound support across sectors?

To design this, we have to look at the full pipeline and its “leakage” points, from getting talent trained and in the door all the way up to the C-suite. These gaps are caused by lack of awareness and support in early childhood education through college, and lack of sponsorship and mentorship in early- and mid- career positions.

Mark Zuckerberg, CEO, Meta, took part in the first-ever Metaverse interview using photo-realistic virtual avatars, demonstrating the Metaverse’s capability for virtual communication.

Zuckerberg appeared on the Lex Fridman podcast, using scans of both Fridman and Zuckerberg to create realistic avatars instead of using a live video feed. A computer model of the avatar’s faces and bodies are put into a Codec, using a headset to send an encoded version of the avatar.

The interview explored the future of AI in the metaverse, as well as the Quest 3 headset and the future of humanity.

To use Sherpa, an instructor first uploads the reading they’ve assigned, or they can have the student upload a paper they’ve written. Then the tool asks a series of questions about the text (either questions input by the instructor or generated by the AI) to test the student’s grasp of key concepts. The software gives the instructor the choice of whether they want the tool to record audio and video of the conversation, or just audio.

The tool then uses AI to transcribe the audio from each student’s recording and flags areas where the student answer seemed off point. Teachers can review the recording or transcript of the conversation and look at what Sherpa flagged as trouble to evaluate the student’s response.

I’m writing to compare “regular” Khan Academy (no AI) to Khanmigo (powered by GPT4), using three of my own made-up criteria.

They are: efficiency, effectiveness, and enjoyability. Efficiency is how fast I am able to cover a math topic and get basic understanding. Effectiveness is my quality of understanding—the difference between basic and advanced understanding. And the final one—most important to kids and maybe least important to adults who make kids learn math—is enjoyability.

On September 25th, 2023, OpenAI announced the rollout of two new features that extend how people can interact with its recent and most advanced model, GPT-4: the ability to ask questions about images and to use speech as an input to a query.

This functionality marks GPT-4’s move into being a multimodal model. This means that the model can accept multiple “modalities” of input – text and images – and return results based on those inputs. Bing Chat, developed by Microsoft in partnership with OpenAI, and Google’s Bard model both support images as input, too. Read our comparison post to see how Bard and Bing perform with image inputs.

Voice and image give you more ways to use ChatGPT in your life. Snap a picture of a landmark while traveling and have a live conversation about what’s interesting about it. When you’re home, snap pictures of your fridge and pantry to figure out what’s for dinner (and ask follow up questions for a step by step recipe). After dinner, help your child with a math problem by taking a photo, circling the problem set, and having it share hints with both of you.

We’re rolling out voice and images in ChatGPT to Plus and Enterprise users over the next two weeks. Voice is coming on iOS and Android (opt-in in your settings) and images will be available on all platforms.

Will Generative AI Improve Digital Accessibility? — from boia.org

Generative A.I. could reduce the busywork of accessibility
Most digital accessibility issues can be addressed easily with clean code and thoughtful content creation. However, many “easy” fixes still take time to implement, particularly when humans need to be involved.

The Web Content Accessibility Guidelines (WCAG) function as the international standards of digital accessibility. WCAG includes a number of requirements that require a subjective approach, which can create busywork for developers, designers, and writers.

For example:

  • WCAG requires text alternatives (alt text) for images and other non-text content. Writing alt text takes a few seconds, but if you’re operating a large eCommerce site with thousands of images, you may need to spend days or weeks adding alt text.
  • WCAG requires captions and transcripts for video content. If you don’t plan for those features when drafting your videos, you’ll need to write them after-the-fact — and on a lengthy video, that’s a time-consuming process.
  • WCAG requires content to maintain an appropriate color contrast ratio. Adjusting your website’s CSS (Cascading Style Sheets) isn’t especially difficult, but on a complex website, designers may need to spend hours adjusting each element.

Generative A.I. may be able to address these challenges.

One of the biggest challenges to navigate now is the fact that more digital tools will come with generative AI already embedded in them, says Annette Vee, director of composition and an associate professor at the University of Pittsburgh. “It’s everywhere in professional writing.”

“We need to be fundamentally rethinking ways we teach writing, so we are thinking about integrating tools mindfully,” says Vee, who helped develop a new resource, TextGenEd, that provides guidance in this area. “The real challenge is how do we teach courses that are preparing students and that are smart about generative AI? We have very few teachers currently equipped to do that work.”

“It’s best if there are real stakes attached to the work, for example, an authentic audience the student is writing to,” he writes. “A subject on which students have both sufficient interest and knowledge in order to feel as though they can write convincingly to this audience also matters a lot.”
