Consider the following items\/reflections.<\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/www.highereddive.com\/news\/inside-one-of-the-nations-few-hybrid-jd-programs\/627869\/\" target=\"_blank\" rel=\"noopener\"><strong>Inside one of the nation\u2019s few hybrid J.D. programs<\/strong> <\/a>&#8212; from highereddive.com by Natalie Schwartz<br \/>\n<em>Shannon Gardner, Syracuse law school\u2019s associate dean for online education, talks about the program\u2019s inaugural graduates and how it has evolved.<\/em><\/p>\n<p><em>Excerpt <span style=\"color: #800000;\">(emphasis DSC):<\/span><\/em><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #800000;\"><strong>In May, Syracuse University\u2019s law school graduated its <em>first class<\/em> of students earning a Juris Doctor degree through a hybrid program, called JDinteractive, or JDi.<\/strong> <\/span>The 45 class members were part of almost 200 Syracuse students who received a J.D. this year, according to\u00a0a university announcement.<\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #800000;\">The private nonprofit, located in upstate New York, won approval from the American Bar Association in <strong>2018<\/strong> to offer the three-year hybrid program.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #800000;\"><strong>The ABA strictly limits distance education, <\/strong>requiring a waiver for colleges that wish to offer more than one-third of their credits online. <strong>To date, the ABA has only approved distance education J.D. programs at\u00a0about a dozen schools, including Syracuse.<\/strong><\/span><\/p>\n<blockquote><p><span style=\"color: #ff6600;\"><strong>Many folks realize this is the future of legal education \u2014 not that it will replace traditional programs. It is one route to pursue a legal education that is here to stay. I did not see it as pressure, and I think, by all accounts, we have definitely proven that it is and can be a success.<\/strong><\/span><\/p>\n<p style=\"text-align: right;\"><span style=\"color: #ff6600;\">Shannon Gardner, associate dean for online education\u00a0\u00a0<\/span><\/p>\n<\/blockquote>\n<hr \/>\n<p><em><span style=\"color: #800000;\">From DSC:<\/span><\/em><br \/>\n<span style=\"color: #800000;\"><strong>It was March 2018.<\/strong> I just started working as a Director of Instructional Services at a law school. I had been involved with online-based learning since 2001. <\/span><\/p>\n<p><span style=\"color: #800000;\"><strong>I was absolutely shocked at how far behind law schools were in terms of offering 100% online-based programs.<\/strong> I was dismayed to find out that 20+ years after such undergraduate programs were made available &#8212; and whose effectiveness had been proven time and again &#8212; that there were no 100%-online based Juris Doctor (JD) programs in the U.S. (The JD degree is what you have to have to practice law in the U.S. Some folks go on to take further courses after obtaining that degree &#8212; that&#8217;s when Masters of Law programs like LLM programs kick in.)<\/span><\/p>\n<p><strong><span style=\"color: #800000;\">Why was this I asked? Much of the answer lies with the <em>extremely tight control<\/em> that is exercised by the <a href=\"https:\/\/www.americanbar.org\/\" target=\"_blank\" rel=\"noopener\">American Bar Association (ABA).<\/a> <\/span><\/strong><span style=\"color: #800000;\">They essentially lay down the rules for how much of a law student&#8217;s training can be online (normally not more than a third of one&#8217;s credit hours, by the way). <\/span><\/p>\n<p><span style=\"color: #800000;\"><strong>Did I say it&#8217;s 2022?<\/strong> And l<\/span><span style=\"color: #800000;\">et me say the name of that organization again &#8212; the<strong> American Bar Association (ABA).<\/strong><\/span><\/p>\n<p><img decoding=\"async\" class=\"size-full wp-image-56848 aligncenter\" src=\"http:\/\/danielschristian.com\/learning-ecosystems\/wp-content\/uploads\/2016\/09\/ExponentialPaceOfChange-DanielChristianSep2016.jpg\" alt=\"\" width=\"100%\" height=\"100%\" srcset=\"https:\/\/danielschristian.com\/learning-ecosystems\/wp-content\/uploads\/2016\/09\/ExponentialPaceOfChange-DanielChristianSep2016.jpg 595w, https:\/\/danielschristian.com\/learning-ecosystems\/wp-content\/uploads\/2016\/09\/ExponentialPaceOfChange-DanielChristianSep2016-150x97.jpg 150w\" sizes=\"(max-width: 595px) 100vw, 595px\" \/><\/p>\n<h6 style=\"text-align: center;\"><em>Graphic by Daniel S. Christian<\/em><\/h6>\n<p><span style=\"color: #800000;\"><strong>Not to scare you (too much), but this is the organization that is supposed to be in charge of developing lawyers who are already having to deal with issues and legal concerns arising from the following technologies:<\/strong><\/span><\/p>\n<ul>\n<li><span style=\"color: #800000;\">Artificial Intelligence (AI) &#8212; Machine Learning (ML), Natural Language Processing (NLP), algorithms, bots, and the like<\/span><\/li>\n<li><span style=\"color: #800000;\">The Internet of Things (IoT) and\/or the Internet of Everything (IoE)<\/span><\/li>\n<li><span style=\"color: #800000;\">Extended Reality (XR) &#8212; Augmented Reality (AR), Mixed Reality (MR), Virtual Reality (VR)<\/span><\/li>\n<li><span style=\"color: #800000;\">Holographic communications<\/span><\/li>\n<li><span style=\"color: #800000;\">Big data<\/span><\/li>\n<li><span style=\"color: #800000;\">High-end robotics<\/span><\/li>\n<li><span style=\"color: #800000;\">The Metaverse<\/span><\/li>\n<li><span style=\"color: #800000;\">Cryptocurrencies<\/span><\/li>\n<li><span style=\"color: #800000;\">NFTs<\/span><\/li>\n<li><span style=\"color: #800000;\">Web3<\/span><\/li>\n<li><span style=\"color: #800000;\">Blockchain<\/span><\/li>\n<li><span style=\"color: #800000;\">&#8230;and the like<\/span><\/li>\n<\/ul>\n<p><strong><span style=\"color: #800000;\">I don&#8217;t think there&#8217;s enough time for the ABA &#8212; and then law schools &#8212; to reinvent themselves. We no longer have that luxury. <\/span><\/strong><span style=\"color: #800000;\">(And most existing\/practicing lawyers don&#8217;t have the time to get up the steep learning curves involved here &#8212; in addition to their current responsibilities.)<\/span><\/p>\n<p><strong><span style=\"color: #800000;\">The other option is to use teams of specialists, That&#8217;s our best hope. <\/span><\/strong><strong><span style=\"color: #800000;\">If the use of what&#8217;s called <em>nonlawyers<\/em>* doesn&#8217;t increase greatly, the U.S. has little hope of dealing with legal matters that are already arising from such emerging technologies.\u00a0<\/span><\/strong><\/p>\n<p><strong><span style=\"color: #800000;\">So let&#8217;s hope the legal field catches up with the pace of change that&#8217;s been accelerating for years now. If not, we&#8217;re in trouble.<\/span><\/strong><\/p>\n<p style=\"text-align: right;\"><span style=\"color: #800000;\">* <em>Nonlawyers<\/em> &#8212; not a very complimentary term&#8230;<br \/>\nI hope they come up with something else.<br \/>\nSome use the term Paralegals.<br \/>\nI&#8217;m sure there are other terms as well.\u00a0<\/span><\/p>\n<hr \/>\n<p><em><span style=\"color: #800000;\">From DSC:<\/span><\/em><br \/>\n<span style=\"color: #800000;\">There is hope though. As Gabe Teninbaum just posted the resource below (out on Twitter). I just think the lack of responsiveness from the ABA has caught up with us.
