Mr. Caplan was concerned that if his daughter \u201cwas caught \u2026she\u2019d be finished,\u201d and that her faked ACT score should not be set \u201ctoo high\u201d and therefore not be credible. Beyond that, all we know from the transcripts about Mr. Caplan\u2019s ethical qualms is that \u201cto be honest, it feels a little weird. But.\u201d<\/p>\n<p style=\"padding-left: 40px;\">That\u2019s the line that stays with me, right through the \u201cBut\u201d at the end. I want to tell you why, and I especially want to tell you if you\u2019re a law student or a new lawyer, because it is extraordinarily important that you understand what\u2019s going on here.<\/p>\n<p style=\"padding-left: 40px;\">&#8230;<\/p>\n<p style=\"padding-left: 40px;\">So why does any of this matter to lawyers, especially to young lawyers? Because of that one line I quoted.<\/p>\n<blockquote style=\"padding-left: 40px;\">\n<p style=\"padding-left: 40px;\"><span style=\"color: #ff6600;\"><strong>\u201cI mean this is, to be honest, it feels a little weird. But.\u201d<\/strong><\/span><\/p>\n<\/blockquote>\n<p style=\"padding-left: 40px;\">Do you recognize that sound? That\u2019s the sound of a person\u2019s conscience, a lawyer\u2019s conscience, struggling to make its voice heard.<\/p>\n<p style=\"padding-left: 40px;\">This one apparently can\u2019t muster much more than a twinge of doubt, a feeling of discomfort, a nagging sense of<em>\u00a0this isn\u2019t right and I shouldn\u2019t be doing it<\/em>. It lasts for only a second, though, because the next word fatally undermines it.\u00a0<em>But<\/em>. Yeah, I know, at some fundamental level, this is wrong.\u00a0<em>But<\/em>.<\/p>\n<p style=\"padding-left: 40px;\">It doesn\u2019t matter what rationalization or justification follows the\u00a0<em>But<\/em>, because at this point, it\u2019s all over. The battle has been abandoned.
